Preliminary Approval of Class Action against Kellogg

The U.S. District Court for the Southern District of California has granted preliminary approval to the settlement between Kellogg and a nationwide class. Plaintiffs alleged that Kellogg's ads falsely claimed Kellogg's cereal could improve children's memory and attentiveness by up to 20%. Those statements, however, were not adequately supported by scientific research. The $4 million settlement reimburses purchasers of its Frosted Mini Wheats cereal. The class consists of all parents who purchased Frosted Mini-Wheats cereal from January 28, 2008, up to and including October 1, 2009.
