Bethlehem IESI Landfill operators explain odors to residents in Lower Saucon Township, Pennsylvania

WFMZ-TV is reporting that at a recent meeting with concerned residents and township council, the landfill presented studies showing that there should be no concern regarding the amount and contents of leachate the landfill is producing, which at least one council member disagreed. However, what was most concerning, was this comment made by DEP program manager William Tomayko regarding the odors:

“But just because someone can smell an odor doesn’t mean there’s a violation. … Of course you can smell an odor [near a landfill], it’s rotting garbage.”

I completely disagree with this statement. A landfill should not be operated in a manner which substantially interferes with some else’s use and enjoyment of their property. If a landfill is operated properly you should not smell rotting garbage while at your home just because your house happens to be located in the vicinity of a landfill.

While I do not currently represent anyone at this site, I do represent hundreds of similarly situated people around the country in various landfill odor and environmental litigation. To find out if The Simon Law Firm can help with an environmental lawsuit, contact Todd Hageman.
