Action against Central Landfill in Johnston, Rhode Island

We have been blogging about the horrible odors in the Johnston, Rhode Island area coming from the Central Landfill. Residents are being affected by noxious hydrogen sulfide odors from distances we do not typically see. These are residents who don't think of themselves as "living next to a landfill." MSN had previously reported that complaints have been made from as far as 14 miles away in Massachusetts. Rhode Island State Representative Stephen Ucci said that he has received more constituent calls about the odor than any other issue in his seven years in the Legislature.

WPRO News Talk 630 has reported that Johnston town officials sued the operators of the Central Landfill, Rhode Island Resource Recovery, and a private energy firm, Broadrock Renewables, over the hydrogen sulfide odors that have been plaguing the community for months. Further, Providence Business News is reporting that the Rhode Island DEM has installed air monitoring equipment earlier this week and will be monitoring the odors.

Just because the local government has taken action, does not mean that individual residents do not also have a nuisance claim for loss of enjoyment of their homes.
