A surgeon used a Mogen circumcision claim and amputated 85% of the tip of an infant's penis. Plaintiff filed claims against the manufacturer alleging that the device was defective. The plaintiff claimed that the clamp did not allow the surgeon to see the penis' tip and that it lacked a back-up safety device, present in all competing devices, which would have prevented amputation. The parties settled for $4.6 million dollars.
