We had previously blogged that after ignoring an EPA demand to submit testing protocols, the EPA raided the Tonawanda Coke's plant in Tonawanda, New York. Residents who had been complaining about noxious odors, and soot in the air and on their property, were relieved that something may finally be done to help them.

The Buffalo News is reporting that the EPA has issued an order to correct deficient operating procedures, and to explain releases of coke oven gas last month and in 2009. They were also cited for being in violation of the Clean Air Act.

We will be monitoring this situation closely. While I do not represent anyone in Tonawanda, New York, I do represent hundreds of similarly situated people around the country in environmental litigation cases.
