DEP sued Kamax Landfill in Panama City, Florida months before fire broke out

We have been following the fire at the Kamax Landfill (incorrectly reported by some sources at K-Max) in Panama City, Florida. The News Herald has now reported that the Florida DEP had filed suit against Demolition Disposal, Inc., the owner of the landfill, in April, 2010. The petition alleges that landfill workers “accepted and then failed to segregate and properly dispose of waste other than construction and demolition debris.” According to court records, the case was closed in September when the court received notice that the owner of Demolition Disposal, Inc. had died.

Meanwhile, efforts by local fire departments have only kept the smoldering blaze from spreading to nearby woods.

We will be monitoring this story for developments. I represent hundreds of similarly situated people around the country, including in the Florida panhandle, in various landfill litigation.
