Baseball coach awarded $35.6 million for "Viper" Exercise Device

A 27-year-old high school baseball coach utilized the "viper" while working with a group of players. The viper is a strength-training device with a bungee like piece of rubber tubing and harness. The coach was using the device when it then snapped, retreated back and hit him in the face causing him to sustain bilateral orbital blowout fractures of both eyes, facial lacerations, left lens damage, bilateral dislocated lenses, traumatic cataract, in-vitreous hemorrhage in the right eye and increased intraocular pressure in the right eye.

Plaintiff claimed the viper was defectively designed and manufactured. Plaintiff settled with the manufacture of the rubber tubing, Primeline Industries, for $1.5 million. The case against Speed City, the manufacture of the product, proceeded to trial and resulted in a verdict in favor of the plaintiff for $35.6 million, including $17.8 million in punitive damages.
